Effective January 1, 2026, New Hampshire updated the penalties for a section of its Reckless Driving statute, targeting drivers alleged to be traveling at 100 mph or greater. Under this per se theory, driving at or above 100 mph is considered reckless regardless of other circumstances.
100 MPH or Greater (Updated Penalties)
Drivers charged under this theory now face: a 90-day mandatory minimum license suspension for a first offense; fines ranging from $750 plus penalty assessment ($930 total) up to $1,000 plus assessment; and up to one year of license loss for subsequent offenses.
General Reckless Driving (Unchanged)
The broader reckless driving provision under RSA 265:79 remains unchanged. This section covers driving that endangers public safety or is conducted on a bet, wager, or race. It encompasses unsafe lane changes, disregarding signage, driving recklessly in poor weather, racing, and many other scenarios beyond mere speeding.
Penalties include a 60-day mandatory minimum license suspension for a first offense (up to one year for subsequent offenses), and fines from $500 plus 24% penalty assessment ($620 total) up to $1,000 plus assessment.
Additional Consequences
Reckless Driving carries more demerit points than a speeding ticket and qualifies as a “major” motor vehicle offense under New Hampshire’s Habitual Driving Offender law (RSA 259:39), which can trigger severe additional suspensions for those with prior qualifying convictions.
Despite these harsh penalties, Reckless Driving remains a civil-level offense in New Hampshire — meaning no jail time is possible, and defendants have no right to a court-appointed attorney.
