A Habitual Offender designation is one of the most serious penalties the Bureau of Motor Vehicles (BMV) can impose. Under 29-A M.R.S. §2558, Habitual Offender revocations last at least four years, and driving during this time is a criminal offense with mandatory jail.
Penalties
- Mandatory minimum 30 days in jail for a first conviction
- $1,000 minimum fine
- Additional suspension time
- Felony exposure for repeat HO offenses

Collateral Consequences
- A permanent felony record for repeat violations
- Difficulty securing employment or housing
- Loss of CDL and disqualification from driving jobs
- Increased insurance rates
Bowser Law’s Defense Strategy
We focus on:
- Reviewing whether your HO designation was accurate
- Determining if the BMV provided proper notice of revocation
- Challenging the lawfulness of the stop
- Negotiating for charge reductions or alternative sentencing
